By Italian Decree No. 108 of March 21, 2024, the Minister of Culture amended the previous Decree No. 161 of April 11, 2023, concerning the guidelines for determining the minimum fees and charges for the licensing of Italian cultural heritage assets.
The scope of application of the Decree includes reproductions made through photographic prints, photocopies, digital images, slides, microfilms, and digital screen prints.
The fee for use is determined by multiplying a unit rate by a coefficient differentiated according to the use/purpose of the reproductions and their quantity.
Among the most significant innovations introduced by the Decree is the explicit indication of specific cases in which reproductions are provided free of charge.
Within this scope, among others, are reproductions of cultural heritage assets:
for volumes recognized by the granting entity as having scientific and academic value or containing divulgative and educational content;
for art catalogs, exhibition and cultural event catalogs with a print run of up to 4,000 copies;
for scientific journals and Class A journals as listed by ANVUR;
for publications freely accessible to anyone without payment of a fee (so-called open access).
